L’identità degli Stati membri delimita le competenze europee e il processo di integrazione, in quanto il nucleo essenziale e inviolabile delle loro costituzioni può essere opposto all’efficacia del diritto europeo. Tuttavia, il processo di integrazione europea e la base della sovranità legale dell’Unione europea trae il proprio fondamento non dalle Costituzioni nazionali, ma dalla comune volontà degli Stati membri di dare vita ad un comune ordinamento giuridico.
La situazione dell’ultimo decennio mostra alcune fratture nel processo di integrazione, che mettono in discussione la stessa sovranità legale dell’Unione europea. Invero, de facto, alcuni Stati membri hanno guadagnato una posizione diversa rispetto agli altri. Ciò può essere visto nel veto espresso dalla Francia (2005), nell’opzione politica del Tribunale costituzionale federale tedesco adottata nella Lissabon Urteil (2009) e nel TSCG (2012). In particolare, tramite quest’ultimo è stata realizzata un’attribuzione della sovranità di bilancio non all’Unione europea, bensì, con tutta evidenza, ad alcuni Stati membri.
The MS identity delimits the European competences and the integration process, because the essential inviolable core of their constitution can be opposed to the European law. Nevertheless, the European integration process and the basis of the legal sovereignty of the European order started not from the national constitutions, but from the common will of the member states to give life to a common legal order.
The situation of the last decade shows some fractures in the integration process, which call into question the same legal sovereignty of the European Union. Indeed, de facto, some MS have obtained a different position in respect to the others. That can be seen in the veto expressed by France (2005), in the political opinion of the German Constitutional Court in the Lisbon-Judgment (2009) and in the TSCG (2012). In particular, with the latter it has been realised an assignment of budget-sovereignty not to the EU, but evidently to some MS.
